Welcome to our Construction Law Department! Here we have an international mix of lawyers who have studied and worked in several jurisdictions. Some of these jurisdictions have a civil code legal system (Cambodia, Thailand, Korea and UAE) and others have a common law legal system (UK, Australia).
Practical experience of these systems gives us a broad and well-rounded international knowledge and legal understanding, especially where one or more foreign laws might apply to a multi-national project, whether or not to be carried out in Cambodia.
Of course, being a Cambodia Bar Association registered law office we advise on Cambodian Law and are not regulated by the Association to give foreign law advice. However, where necessary, we are able to work alongside fellow lawyers from other relevant jurisdictions in order to monitor how any applicable foreign law might affect the legal position of any party to the transaction.
Below is a general description of the type of services related to the construction industry that we carry out:
- Drafting and negotiating building and engineering contracts, joint venture agreements, consultants‘ terms of engagement, warranty agreements, industry standard forms of contracts (e.g. FIDIC terms), and generally, for construction, engineering, manufacturing, oil, water, power and infrastructure projects;
- Available for day-to-day contact for providing commercial and legal advice on issues arising from major projects. This might include one of our lawyers to be seconded to the client’s office from time to time;
- Advice on insurance law, insurance policies and the handling and settling of insurance claims;
- Advice on contractual risk assessment and risk allocation in a construction and insurance context;
- Handling and negotiating claims and, where necessary, resolving disputes through litigation, arbitration, adjudication, conciliation, and mediation;
- Managing teams of lawyers and other construction industry professionals to help resolve complex technical, commercial and legal issues often involving the handling and managing of substantial documentation to prove and resolve these complex issues;
- Advising on any project-related regulatory issues, corporate matters and real estate requirements for doing business in Cambodia;
- Drafting, negotiating and advising on general commercial contracts including hotel and resort construction and management, sale of goods, manufacturing, transportation and logistics contracts and any other services within a construction context;
Aside from having the technical, commercial and legal ability to advise at all stages of the construction process, we are also very well-connected in the construction and real estate industry and are able to speedily assess a reasonable time-frame to facilitate obtaining the necessary documentation and completing the legal requirements on any given project.
