M&A ESG Policy

Our Environmental, Social, and Governance (ESG) Policy reflects our dual commitment to operating our firm responsibly and delivering legal solutions to clients while navigating Cambodia’s rapidly evolving ESG regulatory landscape. By embedding ESG principles into our daily operations and client advisory services, we strive to lead by example within the Cambodian legal community.

Cambodia’s economic and regulatory environment is undergoing a major shift toward sustainability and accountability. Key developments such as the Code on Environment and Natural Resources, the mandatory Extended Producer Responsibility (EPR) framework, and the SERC Directive on ESG Disclosure for listed companies mean that environmental compliance and ethical corporate governance are no longer optional. For businesses, foreign investors, and financial institutions operating in Cambodia, integrating robust ESG practices is essential to mitigate regulatory risks, unlock sustainable capital, and build stakeholder trust. 

Our policy addresses our internal firm operations and advisory practices across three core pillars:

1. Environmental

  • Sustainable Operations: Transitioning toward digital-first case management, paperless workflows, and energy-efficient office systems.
  • E-Waste & Resource Management: Partnering with eco-certified recyclers to manage electronic waste in accordance with Cambodia’s EPR framework.
  • Green Practice Area: Advising project developers, investors, and corporate clients on Environmental Impact Assessments (EIAs), renewable energy projects, and environmental compliance. 

2. Social Responsibility & Community Engagement

  • Diversity, Equity, and Inclusion (DEI): Enforcing merit-based, non-discriminatory recruitment, retention, and advancement across gender, background, and ability. 
  • Pro Bono Legal Service: Dedicating billable-equivalent hours annually to support NGOs, community organizations, and vulnerable populations. 
  • Legal Opportunity & Human Capital Development: Partnering with Cambodian universities to provide legal clinics, mentorship, and professional opportunities for the next generation of legal talent.

3. Governance, Ethics, and Compliance

  • Zero-Tolerance Anti-Corruption: Enforcing strict anti-bribery standards in alignment with Cambodia’s Law on Anti-Corruption and international standards.
  • BAKC Ethics & Transparency: Upholding the Bar Association of the Kingdom of Cambodia code of Ethics through transparent fee structures, clear billing practices, and absolute client confidentiality.
  • Accountability & Audits: Conducting regular internal reviews and reporting to track our ESG progress and metrics over time.
